Retribution

An interview with a former National Security Advisor Zbigniew Brzezinski speaking to the subject of the Israeli-Palestinian conflict and the recent escalation in tensions leading to the December 2008 Israeli-Hamas Conflict.

From Wikipedia is a definition of Retributive Justice

Retributive justice is a theory of justice that considers that proportionate punishment is a morally acceptable response to crime, with an eye to the satisfaction and psychological benefits it can bestow to the aggrieved party, its intimates and society.

Further reading on the Wikipedia definition of retribution, the following statement appears …

In ethics and law “Let the punishment fit the crime” is the principle that the severity of penalty for a misdeed or wrongdoing should be reasonable and proportional to the severity of the infraction. The concept is common to most cultures throughout the world. Its presence in the ancient Jewish culture is shown by its inclusion in the law of Moses, specifically in Deuteronomy 19:17-21, which includes the punishments of “life for life, eye for eye, tooth for tooth, hand for hand, foot for foot.” Many other documents reflect this value in the world’s cultures. However, the judgement of whether a punishment is appropriately severe can vary greatly between cultures and individuals.

Obama expects stimulus after inauguration.

“We don’t anticipate that Congress will have passed both houses an economic recovery and reinvestment plan by the time the inauguration takes place,” Gibbs said.

Gibbs agreed with House Majority Leader Steny Hoyer’s (D-Md.) comments earlier Sunday that any kind of package is unlikely before early to mid-February.

Obama to detail economic vision.

Barack Obama will lay out his vision for a massive economic stimulus plan in meetings with congressional leaders Monday. Perhaps more important, he’ll be taking a major step toward rebuilding the broken relationship between the executive branch and the legislative branch.

Doing so will be critical to the success of his agenda.

If Obama seems unwilling to take lawmakers’ ideas into account, he could risk whatever goodwill he’s getting from the GOP and irk Democrats expecting to play a big role in a new Washington. But if Obama bends to the demands of Nancy Pelosi, Harry Reid, Mitch McConnell and John Boehner, the public could perceive him as a weak president even before he takes the oath of office.

Minnesota Senate Race May Be Certified Today

As far as state election officials are concerned, all the votes have been counted in the Minnesota Senate race and Al Franken won by 225 votes. However, Sen. Norm Coleman (R-MN) has asked the Minnesota Supreme Court to count additional votes (in Coleman-friendly territory). The court has not yet ruled on Coleman’s request. It should be remembered that two of the seven members of the court are on the canvassing board, including chief justice Eric Magnuson. It seems unlikely that Magnuson (the justice) will tell Magnuson (the canvasser) that he screwed up. However, it is possible that he and associate justice G. Barry Anderson will recuse themselves from voting on the case. Coleman has said that if his request is denied he will file another lawsuit, probably alleging that votes in some (Franken-friendly) precincts were counted twice. With the Senate set to reconvene tomorrow, the court may act today. It is not unheard of to have courts act within a day, for example, hearing last minute appeals from prisoners scheduled to be executed that day.

Now let me think. Do we risk the Republicans throwing a tantrum over them not being able to throw a spanner in the works? Or do we want to be able to pass good legislation without the Republicans interfering? Let me think. Hmmmm, it’s such a hard decision.

“Abolishing term limit reform is the opposite of ‘change,'” the Republicans say in the letter. “Instead, it will entrench a handful of members of the House in positions of permanent power, with little regard for its impact on the American people.”

Repealing the term limits on chairmen won’t have much, if any, impact on Republicans until they return to the majority. Practically speaking, the more important change in the Democrats’ plan is a move to limit the motion to recommit, a procedural tool that allows members of the minority to tweak legislation on the House floor.

According to Republicans aides familiar with the rules package, the change being considered would prevent members of the minority from effectively killing legislation by sending it back to the committee of jurisdiction.

KR, you have a fellow-traveller: William Buiter, the bankers’ economist….

http://www.nakedcapitalism.com/2009/01/willem-buiter-calls-for-less-us.html

“…..The US Federal government has taken on massive additional contingent liabilities through its bail out/underwriting of the US financial system (and possibly other bits of the US economic system that are too politically connected to fail). Together with the foreseeable increase in actual Federal government liabilities because of vastly increased future Federal deficits, this implies the need for a future private to public sector resource transfer that is most unlikely to be politically feasible without recourse to inflation. The only alternative is default on the Federal debt. There is little doubt, in my view, that the Federal authorities will choose the inflation and currency depreciation route over the default route.

If I can figure this out, so can anyone in the US or abroad who follows recent economic developments. The dawning of the realisation will lead to the dumping of the assets….”

Jen, I concur: Garrett has done well as far as I can make out…..due process according to the law….I like that sort of thing….makes me feel that sometimes the system will work. Right now, we need to believe that more than usual….

Yeah, there seems to be a growing list of economists who see this deflationary period as mere prelude to an explosion of inflation. Given the Fed’s track record you’d have to be a little inclined to think they’ll get what they want (some inflation) and then some. Bernanke is desperate to get some inflation going now to pull up prices fearing a deflationary death spiral, but be careful what you wish for is the general consensus. Once it starts, ie inflation, the Fed will have to sell vast amounts of the so called ‘assets’ it has accumulated during these ‘rescues’, and it’s anyone’s guess as to whether they’ll be able to do it or even if the said ‘assets’ will have any value by then. If they can’t ‘mop up’ the vast amounts of liquidity they’ve created in desperation, it will come back to bite them (and us) on the bum big time.

As I’m looking at things, KR, we may not have to wait for the inflationary burst to arrive before we see the USD start to crumble. The first hint of trouble in the US Treasury markets will easily provoke the mother of all runs. I noticed this morning that the latest stimulus package has been priced at US 1.3 trill – an extraordinary price tag. No wonder the banks won’t lend any money to anyone any more.

I would suggest that this is a very reasonable perspective from the Israeli ambassador:

“Israel has offered to deal with Hamas as long as it agrees to recognise Israel’s right to exist and renounce terrorism. Such demands are hardly taxing. In response, Hamas continued firing rockets at Israeli civilians.

Israel then entered a six-month unofficial ceasefire with Hamas. Despite it being broken regularly by Hamas, it largely held for five months. In November, Israel discovered a tunnel being dug by Hamas under the Gaza-Israel border. Hamas was planning to use this tunnel to capture and or kill Israeli soldiers. Thus Hamas was preparing for an offensive operation in the midst of a ceasefire period, and Israel was well within its rights to blow up the tunnel, which it did.

Hamas used this defensive, counter-terrorist measure as an excuse to fire 140 rockets at Israeli homes in the last four weeks of the six-month ceasefire period. Only after the December 19 conclusion of the ceasefire period passed, after Hamas ignored Israeli and international calls to extend it, and after more Hamas rockets – averaging 80 each day – hit Israeli homes and schools did Israel decide it had to take decisive action to protect its citizens.

Facing an enemy refusing to recognise its right to exist or even abide by a ceasefire, what alternatives did Israel have? The purpose of the Israeli military operation is to weaken, as much as possible, Hamas’s ability to hurt Israeli civilians. Any other Western country would do the same thing, because protection of one’s civilians is the central obligation of any government. ”

This is a crucial point:

“For as long as Hamas clings to the notion that Israel can be destroyed and it wants to be the one to do so, there will be no peace. ”

Obviously, this is only a snaphot over a brief period of the Israeli/Palestinian conflict – causes and effects reach back deep in time and space. However, this is the problem:

“Hamas’s founding charter includes the statement: “Hamas has been looking forward to implementing Allah’s promise whatever time it might take. The prophet (Mohammed), prayer and peace be upon him, said the time (of resurrection) will not come until Muslims will fight the Jews,” and, “peaceful solutions and the international conferences to resolve the Palestinian problem are all contrary to the beliefs of Hamas.” “

Republicans normally have never seen a tax cut they didn’t love – but that doesn’t seem to be the case with the economic package being prepared by President-elect Barack Obama.

Key GOP members on the Hill are responding warily to word that Obama’s stimulus plan will include about $300 billion worth of tax cuts, expressing tempered support for providing relief but unease about the size of the overall stimulus plan and who will benefit from the cuts.

US 30yr bonds took a hammering over the last few sessions as I’ve been expecting (but wasn’t short, bugger!), and here’s one local view of where it’s going:

…the ‘sell off as confidence revives’ is a tad too simple, and doesn’t account for the elephant in the room: ie, what if confidence in the US’s credit worthiness goes seriously south?

Unthinkable? Yeah, so was a collapse in Lehmans and the debacle that followed.

When the court cases start, Howard can say, “but I got a medal”. That’ll help in court.

Only fourteen more days of crap left. Faster, faster, for god’s sake paddle faster. I can here the banjo’s playing.

I somehow doubt that there are going to be any court cases … At least, no court cases with a chance in hell of succeeding.

Jen, the irony of being given a medal called “Freedom” from the Retard with the lowest ratings of any President ever, just cannot fail to amuse people all around the world.

Johnny on the other hand, is stupid and vain enough to consider it an honour! LOL

Oh, Hi David. International court cases and US court cases. You may be right as far as the succeeding goes. But to not proceed, would be criminal. The Democrats have the Republicans on the ropes. The danger would be that they let them off. The Neocons are almost dead and burried. Not to proceed, would be Lazarus with a triple by pass. Or the Phoenix rising again.

At least I have got my links working properly. It was the quotation marks in the example in the playground, which I was coping and pasting. For some reason the quotation marks in the example are wrong.

International court? Impossible – the US does not recognise the jurisdiction of the interntational court.

National court? Foolish – it will simply enable the republicans to claim persecution from the left while winning the battle in the end. Public relations wise, it would hand a huge victory to them. They would be able to paint their opponents as looney lefties and stir up the anti-anti-Americanism that helped Bush to win the 2004 election.

Obama would be insane to appoint a special prosecutor.

It is VERY obvious that the Republicans and Neocons have NOT learn’t a thing. If the get back again, everything will happen all over again. Ground Hog Day.

Definitely not David, you seem to have got things back to front again. Time will tell as usual. Oh, Australia does recognise the International court. So the can get Howard and Blair. Not to proceed would be very dangerous for the Democrats.

How on earth is the international court going to get Howard and Blair? On what charges? Assuming that charges of torture and illegal wiretapping can be made against Cheney and Bush, Howard did not torture anyone; Howard did not illegally wiretap. Neither did Blair. You are indulging in lunatic left-wing fantasies, I’m afraid.

Time has already told. There have been no proceedings lodged in the international court against Blair or Howard. There will be none against Bush or Cheney, either. And there will be none internally in the US against Bush or Cheney that have any credibility whatsoever. As such, Obama will in no way wish to be associated with any such things.

The overall size of the package remains a big question mark, and a potential disagreement between the two chambers. House aides say there’s a general agreement around the amount of $775 billion.

Senate Majority Leader Harry Reid (D-Nev.), pressed for a figure on the overall size, said that Obama was talking about much larger numbers from his discussions with economists.

“He has indicated that there’s at least 20 economists that he’s talked with,” Reid said, “and all but one of those believe it should be from $800 billion to $1.2 trillion or $1.3 trillion.”

US Dumps Unpopular Internet Filter Plan

The US Federal Communications Commission (FCC) doesn’t enjoy a reputation for being particularly cluey, or particularly interested in issues relating to free speech. During the infamous Janet Jackson ‘Nipplegate’ incident at the 2005 Super Bowl, commissioners fell over each other to see who could appear more outraged by the brief glimpse of a partially-bared Jackson breast.

“Americans should not have to tolerate such a gratuitous display of nudity,” one commissioner remarked. (Many of them were apparently prepared to: Nipplegate was the most rewatched moment ever on Tivo.)

Yet even with that “rack and ruin” approach, the FCC has managed to work something out that continues to elude the Australian government: trying to impose censorship on Internet networks is a particularly stupid idea.

What’s unusual about the trip is that Biden’s isn’t going as vice-president-elect, but as the outgoing chairman of the Senate Foreign Relations Committee. His office didn’t say why.

But it did allude to the unusual nature of Biden’s visit, saying, “The fact-finding delegation will make it clear to foreign leaders that they are not there to speak on behalf of the U.S. government, or convey policy positions for the incoming administration.”

Why the change? “I’m saying if this is a problem for people, let’s take it away,” Martin said. “A lot of public interest advocates have said they would support this, but were concerned about the filter. There is some talk of renewed optimism in the markets – equities are up, commodities are off their lows, high-yield currencies are up, the debts markets are a tiny bit less risk averse – but basically this is just wishful thinking in my opinion. The knock-on in the real economy is just starting to be felt.

I know in my industry that everyone is expecting final demand to take a terrible battering through 2009. Credit has become like lost youth – a thing of the past – and everyone is battening down for storms in the currency and debt markets. Steep discounting to move stocks and win orders has become almost universal. It is truly daunting.

The financial markets may think the worst is over, but basically this round is just getting started from a real-economy perspective.

The Rudd government’s proposed censorship regime will slow internet access and hand criminals a directory of illegal content, writes Mark Newton

Much has been written about the Rudd government’s proposed ‘clean feed’ internet censorship regime. But it isn’t until you delve into the policy’s unintended consequences that some of its biggest problems come into view. Shamefully for the government, these consequences are entirely predictable for those with a solid grasp of how the technology works. A growing mountain of criticism rightly targets the policy’s cost, its likely performance impact, the impossibility of its meeting required reliability standards, its expense, and the fact that its compulsory nature violates an ALP election promise.
But further gems of controversy have attracted little attention, and deserve to be brought to light. None are particularly complicated; all are damning.

Franken Certified Winner Of Minn. Recount.

A Minnesota board on Monday certified results showing Democrat Al Franken winning the state’s U.S. Senate recount over Republican Norm Coleman, whose lawyer promised a legal challenge that probably will keep the race in limbo for months.

The Canvassing Board’s declaration started a seven-day clock for Coleman, the incumbent, to file a lawsuit protesting the result. His attorney Tony Trimble said the challenge will be filed within 24 hours. The challenge will keep Franken from getting the election certificate he needs to take the seat in Washington.

“This process isn’t at an end,” Trimble said. “It is now just at the beginning.”

Franken Declared the Winner in Minnesota

The Minnesota canvassing board has declared Democrat Al Franken the winner of the hotly contested Senate race there. Sen. Norm Coleman (R-MN) filed a suit with the state Supreme Court but the court threw it out yesterday. Coleman vowed to contest the election with another suit, but the chances of him prevailing in the state courts are slim. Even if he gets most of what he is asking for, that is unlikely to produce enough votes to overturn Franken’s margin.

The suit will claim that since each county counted and recounted its own votes without statewide guidance, different standards were used in different counties, thus violating the constitution’s equal protection requirement. Of course, lack of statewide standards applies to all state and federal elections in all states, so that is hardly unique to this case. Thus it seems that his real game plan is to appeal to the U.S. Supreme Court and get a 5-4 decision in his favor as in the Florida 2000 election. Only then, the Supreme Court stopped the counting. Now the counting is finished. It is not clear what the court could decide–maybe force a recount of the entire state?

Former Florida governor Jeb Bush has chosen not to run for the Senate seat being vacated by Sen. Mel Martinez (R) in Florida. It was widely believed that if he had run, he would have been the favourite to win the election. A second bonus for the Democrats is that their attempts to convince Florida’s Chief Financial Officer Alex Sink, likely their best candidate for the race, to run will be boosted by the fact that his biggest opponent is now out of the running.
